If any provision of this Agreement is declared or found to be unlawful, unenforceable or void, such provision will be ineffective only to the extent that it is found unlawful, unenforceable or void, and the remainder of the provision and all other provisions shall remain fully enforceable.
Any and all claims or disputes between you and CanLaw Inc.(or any CanLaw Inc subsidiaries or affiliates)
arising out of or relating in any way to the product or this
Agreement shall be resolved through mediation or if needed final, binding arbitration.
This arbitration obligation applies regardless of whether the claim or dispute involves a tort, fraud, misrepresentation, product liability, negligence, violation of a statute, or any other legal theory.
Both you and CanLaw Inc. specifically acknowledge and agree that you waive your right to bring a lawsuit based on such claims or disputes
CanLaw may litigate if mediation or arbitration appear to be futile in the sole opinion of CanLaw.
All administrative expenses of mediation or arbitration proceedings commenced under this Agreement shall be divided equally between you and CanLaw Inc. including the fees and expenses and any costs of the arbitrator except that you acknowledge and agree that each party shall pay the fees and costs of its own counsel, experts and witnesses.
All of the material on CanLaw is copyright either by CanLaw Inc. it’s owners, or in the case of outside material, copyright by those producers. You may not use it without payment or written permission from the owners in advance

Reproduction for commercial purposes is not permitted.
In particular, but without limiting the foregoing: In no circumstances shall CanLaw Inc., its owners, officers or employees be responsible or liable for any loss or damages whatsoever, including, without limiting the generality of the foregoing, any direct, indirect, incidental, special, or consequential damages, arising from or in connection with your use of, access to or your reliance on, or your inability to use or gain access to, the CanLaw web sites, or arising from or in connection with any advice, action or inaction of any person connected with CanLaw.
We also have the right to change any or all of these terms and conditions at any time without notice and to apply them retroactively.
