CanLaw Terms and Conditions

 

All access to and use of the CanLaw (and its related sites) web site is subject to all of the terms and conditions listed. Your use of this site constitutes acceptance of all of our terms.

 

You and all users of this site are bound by any and all of these terms of service and rules which constitute a legal agreement between you and CanLaw Inc. If you do not agree, please do not use this site or our services. If you access and use this web site, you accept and agree you are bound by and will comply with all these terms.

CanLaw reserves the right to change these terms and conditions from time to time without notice.

You release CanLaw Inc. and it's owner, management and staff and agents from any liability that may arise from your use of this site for any reason including but not limited to use as either a consumer of our services or an advertiser, subscriber or customer of CanLaw in any manner.

These terms cover all disagreements and disputes arising in relation to any client, advertiser, customer subscription agreement or referral services provided and/or any other agreement, to all referral users, all site visitors between CanLaw Inc. and all clients or subscribers and all users and customers of this website.

 

Subscribers and all users of this site or the connected services hereby waive forever any right to file civil legal action or law suits against CanLaw Inc. and/or the corporation CanLaw Inc. and/or the owner personally.

 

Any and all disputes are to be resolved only by mediation or arbitration in London, Ontario. Users of this site waive forever the option of suing or taking legal action against CanLaw Inc. and the CanLaw and related sites, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the site for any and all claims, losses, expenses, damages and costs, including reasonable lawyers' fees past, present or future.

 

Everyone, including but not limited to all subscribers and users of this service and site agree to resolve any dispute with us for any reason by way of mediation and or arbitration held only in London Ontario, only using London Ontario mediators.

 SEVERABILITY

If any provision of this Agreement is declared or found to be unlawful, unenforceable or void, such provision will be ineffective only to the extent that it is found unlawful, unenforceable or void, and the remainder of the provision and all other provisions shall remain fully enforceable.

 

Availability of Web Site

You will not be entitled to any money or compensation in any form, for any system error of any type. If there is a system error and you notify us of the same we will try to correct the error.

CanLaw Inc. has a nearly perfect record in being "up" at all times All users must realize and  understand that because of the nature of Internet and online communications media this site or the services may not perform as intended despite our efforts, those of our or your hosting service, your Internet service provider, and you.

 

CanLaw Inc. monitors this site constantly to ensure it is functioning as intended. We cannot and do not guarantee uninterrupted or error free operation of this site.

 

We use reasonable efforts to try and maintain operation of the site and availability of the services at all times.

 

We will attempt to maintain our systems so that no virus, worm, trojan or other type of infection infects them, however while we have never had any such problem, we cannot guarantee that we are immune from attacks.

 

Kirwood Inc. the former owner of CanLaw was closed in 2009 and ceased operations at that time.

 

 

Resolution Of Claims Or Disputes

Any and all claims or disputes between you and CanLaw Inc.(or any CanLaw Inc subsidiaries or affiliates)

arising out of or relating in any way to the product or this

Agreement shall be resolved through mediation or if needed final, binding arbitration.

 

This arbitration obligation applies regardless of whether the claim or dispute involves a tort, fraud, misrepresentation, product liability, negligence, violation of a statute,   or any other legal theory.

 

Both you and CanLaw Inc. specifically acknowledge and agree that you waive your right to bring a lawsuit based on such claims or disputes

 

CanLaw may litigate if mediation or arbitration appear to be futile in the sole opinion of CanLaw.

 

All administrative expenses of  mediation or arbitration proceedings commenced under this Agreement shall be divided equally between you and CanLaw Inc. including the fees and expenses and any costs of the arbitrator except that  you acknowledge and agree that each party shall pay the fees and costs of its own counsel, experts and witnesses.

 

Lawyers, Advertisers, Subscribers

and related Experts using CanLaw Inc. to promote their services:

 

Play Fair with CanLaw and CanLaw will Play Fair with you

All ads, listings and subscriptions run until cancelled in writing by the subscriber/advertiser.

 

Renewals are automatic until cancelled in writing by the client

 

CanLaw Inc. retains the right to accept or reject the listing of any lawyer, or any other individual or company for any or no reason, at any time.

 

These terms of service include the right to terminate any subscriber at any time, for any reason whatsoever without refund.

 

Paid services and referrals are for the use only of the individual who has purchased them and are not to be shared with or access given to any other individuals or firms.

 

Where abuse of our service has been established in our sole and final judgment, no refund will be made and any and all appropriate action will be taken to protect our rights and interests
